The U.S. Supreme Court’s ruling, upholding President Donald Trump’s travel ban, is yet another wrong determination that permits official racism and xenophobia, American Civil Liberties Union (ACLU) said in a statement on Tuesday.
“This is not the first time the Court has been wrong or has allowed official racism and xenophobia to continue rather than standing up to it,’’ the ACLU said via Twitter.
Earlier on Tuesday, the Supreme Court ruled in a 5-4 vote that the government has set forth a sufficient national security justification to survive rational basis review.
The ACLU pointed out that the Supreme Court ruled in 1944 in approval of imprisoning Japanese Americans based on their nationality and called that decision one of the “most shameful’’ in U.S. history.
The ACLU said the Supreme Court ruling on the travel ban ruling joins the Court’s 1944 decision.
On January 27, 2017, Trump signed an executive order barring nationals from Iran, Iraq, Libya, Somalia, Sudan, Yemen and Syria from entering the United States.
The executive order was challenged in court and revised twice to remove Iraq from the list and allow other exceptions.
